Freedom of Information Requests

The Municipal Freedom of Information and Protection of Privacy Act (MFIPPA) requires that municipalities protect an individual's personal information existing in government records. The Act also gives you the right to request access to your personal information in these records.

Accessing Information

Some information and records require you to submit a formal written request for access to this information under the MFIPPA. Contact us to find out if the information you want requires a formal written request.

To submit a request you must complete the Freedom of Information Request form

We will process your request within 30 days of receiving the request. If the request is going to take longer, we will advise you about the time extension required.

Fees

Depending on the type of request, you may need to pay for the additional cost of preparing the records. This may include search time and photocopying. If the total amount is over $25, we will provide you with a written cost estimate before processing your request.

Document Search for items not covered in the Freedom of Information Act will be charged a fee of $20.00 minimum, at $20.00 per hour plus tax.

You must pay all fees before we will release the records.

Exemptions

Certain documents may be exempt from a freedom of information request. Please review the different types of exemptions.

We may deny access to records that fall within the mandatory exemptions. This includes:

  • Information received in confidence from another government
  • Financial or commercial information supplied in confidence where providing the information could harm the interests of another party
  • Personal information about individuals other than yourself if the disclosure is an unjustified invasion of personal privacy

For the following information requests it is up to the Township of Brock whether or not to release the information. These requests include:

  • Draft by-laws and records of closed meetings of Council or committees
  • Advice or recommendations of an employee or consultant
  • By-law enforcement matters
  • Release of information that could harm the financial or other interests of the municipality
  • Information under solicitor-privilege, such as legal advice
  • Information which could endanger the health and safety of an individual
  • Information already available to the public through another means or is soon to be published
  • Draft reports prepared by the Municipal Ombudsman or Provincial Ombudsman

Appeals

If you disagree with the decision about access to the information you requested, you may request the Information and Privacy Commissioner to review this decision within thirty days. You can do so by filing an appeal online at www.ipc.on.ca. The appeal fee is $25.00 (for general record requests) or $10.00 (for personal information requests). Alternatively, appeals can still be mailed with a cheque or money order payable to “Minister of Finance” to: Registrar, Information and Privacy Commissioner of Ontario, 2 Bloor Street East, Suite 1400, Toronto, ON, M4W 1A8.
